Terms and Conditions

  1. General

      1. LottoStar is licensed by the Mpumalanga Economic Regulator and undertakes to abide by all the applicable laws, regulations and rules. The contract between LottoStar and the Player is made in terms of these laws and the terms and conditions herein contained. Players agree to abide by all legislated requirements and these terms and conditions. It remains the Players sole responsibility to ensure that they agree and understand all terms and conditions on an ongoing basis. These terms and conditions are and remain binding on the Player.
      2. The opening of an internet betting account and more particularly the conduct of betting transactions between LottoStar and its Players shall be exclusively governed by the Laws of the Republic of South Africa.
      3. Persons under the age of 18 are strictly prohibited from betting.
      4. The Laws of the Republic of South Africa recorded in 1.2 are, inter alia, the following:
        1. the National Gambling Act 33 of 1996 read with its regulations (as amended from time to time);
        2. the Mpumalanga Gambling Act 5 of 1995 read with its regulations (as amended from time to time);
        3. the Financial Intelligence Centre Act 38 of 2001 read with its regulations (as amended from time to time) (“FICA”);
        4. the Protection of Personal Information Act 4 of 2013 read with its regulations (as amended from time to time);
        5. the Electronic Communications and Transactions Act No 25 of 2002 read with its regulations (as amended from time to time); and
        6. the Prevention of Organised Crime Act 121 of 1998 (as amended from time to time).
      5. These terms and conditions may be amended from time to time, as a result of changing operational, legislative or regulatory requirements. It is the Player’s responsibility to ensure that you are aware of all amendments thereto, which will be posted on the LottoStar website as and when they occur and/or are required.
  2. Limitation of Liability

      1. The Player represents and warrants that it shall indemnify and hold harmless LottoStar and its licensors, successors, related entities, directors, officers, agents, members; third party contractors, employees and software providers (collectively, the “LottoStar Parties”) from and against any and all direct, general loss or damage, liabilities, losses, interest or penalties of whatsoever nature (whether direct, incidental, consequential, indirect or punitive damages) incurred or sustained by the LottoStar Parties and any costs and expenses (including, but not limited to reasonable attorneys’ fees) from claims or actions against any of the Licensor Parties based upon or from any information, content, materials or communications transmitted, received, displayed, used and/or contained on or through the LottoStar Website and any and all transactions processed thereby; and/or any infringement or improper use by the Player of the LottoStar Service.
      2. The Player indemnifies LottoStar against any harm caused due to inaccurate information obtained from our website or employees, agents and third party service providers, including but not limited to, sports schedules, locations, prices, human error, computer malfunctions, complaints/disputes or results/resulting. LottoStar reserves the right to cancel, at its discretion, any bet or transaction arising from such occurrence. LottoStar will not entertain any claims, and accepts no liability for losses sustained by a Player’s inability to access LottoStar markets or website, due to malfunction, cancellation of accounts, inability to provide markets, suspension of services or otherwise, regardless of the cause.
      3. LottoStar shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with LottoStar's website or its content, including without limitation, delays or interruptions in operations or transmission, loss or interruption of data, communication or system failure, any person's misuse of the website or its content and/or any errors or omissions contained therein.
      4. LottoStar may, at its sole discretion and without incurring liability of any kind, and at any time, suspend the LottoStar service in whole or in part without any prior notification.
      5. LottoStar may in its sole discretion and without incurring any liability of any kind, at any time and for whatsoever reason, suspend and/or deactivate any individual Player account.
      6. LottoStar reserves the right to add to or remove any of the games and/or suite of games it offers without notice. In the event that any bets are affected by the removal of any game/s, LottoStar reserves its rights to cancel any such event and refund the Player.
      7. LottoStar provides all games and/or suite of games without any warranty whatsoever.
      8. The Player indemnifies LottoStar against any loss caused by incorrect credits or debits to his account, including but not limited to, incorrect deposits or winning bet payouts. The Player authorises LottoStar to debit any amounts which have been incorrectly credited (through error, negligence or otherwise) to the Player Account. Any funds/winnings credited to an account in error will not be permitted for use by the Player. LottoStar reserves the right to reverse, adjust and/or void any and all transactions involving such funds, either at the time or retrospectively, as the case may be.
      9. The Player warrants and represents that neither the use, possession or availability of the LottoStar services by the Player will infringe upon or contravene any applicable laws in the jurisdiction in which they reside and or place bets. It shall be the Player's sole responsibility to ensure such compliance and LottoStar shall not be held liable for or in the event of any contravention/s by the Player.
      10. LottoStar recognises that whilst it takes all steps possible to prevent errors or bet rejections (where applicable) during the course of Players' betting transactions, errors or bet rejections may arise as a result of various factors, including but not limited to, computer software and/or computer hardware or human error. In all such events, LottoStar reserves the right to correct these errors and/or cancel the betting transactions and refund the bet (stake) amounts, as the case may be.
      11. All bets that have been validly placed and accepted by LottoStar will not be eligible for cancellation and/or refund.
      12. Without prejudice to any other provision of these Terms and Conditions, LottoStar shall not be liable to any person for:
        1. any event beyond its reasonable control, including without limitation, any act of God, actual or threatened war or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought, tempest and a declaration of a state of emergency and/or disaster;
        2. power cut (inclusive of load shedding) and/or failure or obstruction of any network, broadcasting or telecommunications service including the Player's internet connection;
        3. any disconnection;
        4. any session expiry;
        5. the failure of, or damage or destruction to, or any errors caused by the computer systems or records or any third party (including, without limitation, the Website), or any aspect of the foregoing;
        6. LottoStar shall not be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to any event;
        7. any claims as a result of a Player being under the influence of any inhibiting substances, including but not limited to, drugs, alcohol or any prescribed or other medication.
        8. any downtime of the website or any particular game/s as a result of any system maintenance on the part of LottoStar or any third party;
        9. delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;
        10. any other action or event that prevents or hinders the acceptance of a Bet;
        11. the refusal to sell a Bet to any person or to allow any person to place a Bet;
        12. any losses caused to Players including misuse or unauthorised use/change of Password/s, money lost by placing Bets and failure or malfunction of the equipment or technology of the relevant Player or their Internet service provider; or
        13. bugs or viruses resulting in lost data or any other damage to a Player's computer equipment, mobile phone or mobile device or software.
  3. Registration Procedure and Betting Account

      1. In order to utilise the services provided by LottoStar, the Player will need to open an account. LottoStar reserves the right to reject any registration for a new account, and or cancel an existing account at its sole discretion, and without communication to the Player or applicant. Additionally, LottoStar reserves the right to request all FICA documents as referred to in clause 3.6 below at the time that a Player opens a LottoStar Account or at any point and for whatever reason during the existence of a Player's relationship with LottoStar.
      2. Without limiting the generality of the following, LottoStar shall have the right, in its sole discretion and without prior notice or communication, to suspend, permanently deactivate a Player Account and/or take legal action against a Player immediately if LottoStar is of the opinion and/or can prove that:
        1. any of the provisions contained in these Terms and Conditions have been contravened;
        2. the Player has provided information regarding the Player Account or any deposits made by the Player that are false or misleading;
        3. the Player is using a fraudulent bank account and/or depositing using a lost or stolen card;
        4. the Player has used a payment method without the lawful owner’s consent;
        5. the Player operates or operated more than one Player Account;
        6. the Player is allowing a third-party access to their LottoStar Account in order for that third-party to place bets;
        7. the Player is using the services of LottoStar in a fraudulent manner or in the perpetration of a fraud;
        8. the Player is using the services of LottoStar for an illegal or improper purpose;
        9. the Player has not provided proof of the source of funds deposited for any particular transaction or a series of transactions upon request to do so;
        10. any FICA requirements have not been met by the Player;
        11. the Player is or has attempted to abuse any bonus or promotion;
        12. the Player is trying and/or has taken advantage of any software malfunction, system bug or failure;
        13. any Player transactions are in the opinion of LottoStar suspicious and/or questionable;
        14. any other reason that LottoStar finds to be an acceptable reason to deactivate an account; or
        15. it is required by law to do so.
      3. Players are only permitted one account and are specifically prohibited from opening multiple accounts in the name of or on behalf of other persons or themselves.
      4. LottoStar reserve the right to void any bets that they deem to have been placed by a single Player on multiple accounts. Should a Player have fraudulently created more than one account, LottoStar reserves the right to void any winnings on any account/s. Furthermore, LottoStar reserves the right to void any bonuses and/or promotions, associated with such accounts and all winnings will be forfeited, and the decision will be final and non-negotiable.
      5. In the event that LottoStar receives a report from a third party concerning potentially fraudulent activities, LottoStar reserves the right to deactivate/suspend the betting account without providing any reason. In the event that the implicated betting account has a pending withdrawal, LottoStar reserves the right to cancel such withdrawal until such a time LottoStar and the third party have concluded investigations.
      6. New accounts are enabled for banking and profile updates only. LottoStar will verify an account holder’s identity and age before enabling bet placement on an account.
      7. In terms of the provisions of the Financial Intelligence Centre Act of 2001 it will be necessary for the Player to furnish LottoStar with a copy of the Player’s identity details (from an identity document/passport which must be valid), proof of residence in the nature of a statement/invoice of account (rendered by a City Council or a bank in the case of mortgaged property) and proof of bank account details (which statements shall not be older than 3 (three) months). Additionally, the Player must provide the source of funds which the Player will use to place bets with LottoStar during the course of the relationship. Should you have failed to comply with the provisions of FICA then LottoStar shall be prohibited from paying any credit balance in the Player’s account to the Player.
      8. Any suspicious and/or fraudulent activity on a player account will be reported to the Financial Intelligence Centre and any other authority deemed necessary by LottoStar for criminal investigations to commence.

      10. No withdrawals will be processed until all FICA requirements have been met.
      11. LottoStar reserves the right to use third party verification processes to confirm the information of a Player (including, but not limited to, Players identity, proof of address and banking) and by opening an account and/or accepting these terms and conditions, Players specifically agree that Lottostar may provide such third party verification providers with their details.
      12. At all times the Player must ensure that the details submitted in the opening account form remain up to date. It is a Players sole responsibility to inform LottoStar of any details or particulars that have changed since the date when the account was opened.
      13. All Players are required to supply their identity/passport number, full names, residential address, email address and at least one contact telephone number.
      14. Players warrant that all information set out in the application form is true and correct. LottoStar shall not be held liable in any circumstance where the information provided by a Player is inaccurate and/or outdated.
      15. Completion of the registration process implies that the Player has accepted and understood all of LottoStar’s terms and conditions. If the Player does not accept each and every term of this agreement, they are requested not to logon or open an account.
      16. Players additionally warrant that they are not under the age of 18, they are aware that they might lose their Stake for any bet placed on LottoStar, they are not persons on the Excluded List and they are not depositing monies originating from criminal and/or unauthorised means.
      17. By registering a LottoStar betting account, Players confirm that they are not listed on the register of self-excluded persons as outlined in Section 14 of the National Gambling Act, 2004. Should their status change and they become self-excluded in the future, they hereby agree to notify LottoStar immediately.
  4. Betting Activity

      1. LottoStar will cancel and void any and all bets and return all money deposited to an account that LottoStar or the authorities deem to have been registered by or on behalf of an individual under the age of 18.
      2. LottoStar exclusively reserves the right, at its sole discretion, to limit, reject and/or cancel any bets accepted and confirmed by LottoStar that are deemed to have been fraudulently, accidentally or erroneously placed. In the event that LottoStar suspects fraudulent activity in relation to any account or bet, LottoStar reserves the right to suspend the account and the processing of any and all transactions attributable to that account until LottoStar is satisfied that all transactions concerned are lawful. All bets that are fraudulently placed will be void and LottoStar will report any fraudulent activities to the relevant authority.
      3. LottoStar exclusively reserves the right to limit, reject and/or cancel any bets accepted and confirmed by LottoStar where LottoStar has either negligently, erroneously or otherwise offered or set incorrect prices, teams or event start times including but not limited to incorrect prices, teams or event start times.
      4. A Players bet slip shall be final and binding when determining any maximum payout, irrespective of anything contained to the contrary on the LottoStar website or marketing material.
      5. LottoStar exclusively reserves the right to limit any Manual System Bets accepted and confirmed by LottoStar to a total of 50 Manual System Bets per event/draw. If a Player places more than 50 Manual System Bets per event/draw, the first 50 Manual System Bets will be regarded as valid bet entries (except in the event that any bet contravenes any other Term and Condition of LottoStar). Bets placed in the same event/draw that exceed 50 Manual System Bets will be regarded as null and void and cancelled by LottoStar. In such a scenario, the amount bet/staked on the Manual System Bets that exceed the 50 Manual System Bets permitted will be returned to the Player and any winnings erroneously credited to a Player will be reversed.
        1. For purposes of clause 4.5 above Manual System Bets are defined as a situation where a Player manually (i.e. Player predicts his/her own numbers) creates various combinations of the same numbers by changing bets by one, two or three numbers from any previous bet selections.
        2. For the avoidance of any doubt the provisions of clause 4.5 and 4.5.1 above do not restrict the number of bets a Player can place using the quick pick option or manual bet placement (where the numbers selected do not constitute Manual System Bets).
      6. Bets are only valid when accepted in accordance with all of LottoStar's rules, policies and terms and conditions.
      7. LottoStar reserves the right to change or amend its rules, policies, terms and conditions at LottoStar's own discretion and without notice to Players.
      8. It is the responsibility of the Player to ensure all details of their bet are correct, prior to placing a Bet. Once a Bet has been placed and its acceptance has been confirmed (by on screen acknowledgement and/or bet slip creation) such bet cannot be cancelled or changed by the Player.
      9. If LottoStar suspects that match fixing has occurred, LottoStar reserves the right to withhold all funds on affected accounts and supply all account information to the relevant authorities and/or refund the relevant bets.
      10. LottoStar reserves the right in its sole discretion, to choose the bet offering made available, including but not limited to: the events, markets, all betting options, odds, and the acceptance or refusal of any bets. LottoStar may make available or terminate betting offerings on any sports, events, markets and betting options at its sole discretion and reserves the right to make any changes without notice to the Player.
      11. Players may not bet by any means not authorised by LottoStar, including but not limited to, robots and website or software manipulation. LottoStar reserves the right to cancel any bets deemed to have been placed by unauthorised means.
      12. All bets and markets are subject to minimum and maximum stakes. It is the Player’s responsibility to ensure that they are aware of any stake limit applied. All maximum stakes apply per Player, per bet and per day. The Player warrants that they will not attempt to deliberately exceed the stake limits and any bets placed in an attempt to avoid the application of these limits, including bets placed on accounts held by other Players and multiple bets placed on a single account in order to exceed the stake limit, will be voided at LottoStar’s discretion.
      13. All entries placed for an event that has already past will either receive a full refund or be placed into a future event at LottoStar's discretion.
      14. Players agree that in the unlikely event of a discrepancy between the result that appears on their screen and result displayed on the game server, the result that appears on the game server will prevail.
      15. Without limitation, LottoStar may at its discretion decide about the validity of a Bet or a Player's entitlement to Winnings or void a Bet and a Player cannot claim any Winnings or payout if:
        1. bets were placed after the relevant deadline or after the start of the relevant draw;
        2. bets were erroneously accepted after the relevant deadline or if the relevant drawing had already begun or taken place;
        3. LottoStar becomes aware of an error in relation to that Bet or draw and is not able to contact the Player to correct the error or confirm the bet before the deadline;
        4. the Bet was placed on behalf of a Player who has provided false and/or deceitful information in connection with their Player Account or otherwise in connection with the Website or the services available through it;
        5. the Bet was placed on behalf of a Player who has been involved in any fraudulent, dishonest and/or illegal activities in relation to the placing of the bet, the operation of the Player Account or otherwise in connection with the Website or the services available through it;
        6. it is established that the Player Account has been accessed and/or used to place bets by any person other than the Player themselves.
        7. the Bet was placed on behalf of a Player who is younger than 18 years old or is/was a director, officer, or employee (or their spouse or dependant) of LottoStar or of one of the LottoStar Group companies;
        8. the Player maintains more than one Player Account;
        9. the player is a self-excluded person;
        10. the player is prohibited in any format, including but not limited to, through legislation, regulation, public policy, contract or otherwise from placing or entering into any betting transaction;
        11. in conjunction with any draw, fraud, manipulation, including but not limited to, system and data manipulation, technical and/or human error or unwarranted influence was found;
        12. any website and/or game malfunction occurs;
        13. the draw/round/s is declared by an organiser or co-organiser, independent auditor, as the case may be, as being invalid; or
        14. a Player has used a stolen, lost and/or unauthorised card to deposit into their LottoStar account.
  5. Prohibited Activities

      1. For purposes of these terms and conditions, “prohibited activities” shall include, without limitation, an actual or attempted act by the Player, which LottoStar deems, in its sole discretion,:
        1. constitutes or may constitute a criminal offence;
        2. could or has given rise to civil/criminal liability with the intention to defraud LottoStar and/or circumvent any legal restrictions;
        3. violates any applicable law;
        4. involves any manipulation of the LottoStar systems and/or website;
        5. involves any unethical and/or unfair betting practices, including but not limited to, opposite betting patterns or techniques; and/or
        6. involves any other acts made by the Player in bad faith.
      2. The above acts or attempted acts shall be deemed prohibited acts regardless of whether they cause any damage or harm to LottoStar.
      3. LottoStar reserves the right to institute whatsoever legal action against Players who engage in any of the prohibited activities, and any person who may have benefited from any of the prohibited activities.
  6. Monitoring Account Activity

      1. By using our services, you agree that LottoStar reserves the right to monitor all betting account activity for irregular, unusual, suspicious or unlawful behaviour as part of our ongoing account management. In the event that such activity is detected, LottoStar may take immediate action, including but not limited to the deactivation of a Customer's betting account. This monitoring is conducted in accordance with our legal obligations and is essential for maintaining the integrity of our platform and ensuring a fair and secure betting environment for all Players.
  7. Lotteries

      1. General
        1. The Information and How to Play tabs (hereinafter referred to as the “Game Rules”) available on each game should be consulted and understood before a Player engages with the Lotteries events. The Player undertakes and warrants that all of the Game Rules are understood and agreed to.
        2. The Paytable (available on each Lotteries event) displays the wins for the combination of matched number/s that are achieved.
        3. The Lotteries events are fixed odds betting events that result off of the outcome of a highly secure and independently certified Random Number Generator (“RNG”). Players agree that in the unlikely event of a discrepancy between the result that appears on their screen and result displayed on the game server, the result that appears on the game server will prevail. Players acknowledge and agree that LottoStar’s technical records will be the final authority in determining the circumstances of a Player’s participation in the relevant betting activity and the results of such participation.
        4. By placing a bet on the Lotteries events, Players undertake and accept to comply with all of the Game Rules of each particular Lotteries event.
        5. Only one payout may be won per Lotteries event bet.
        6. All bets that have been validly placed and accepted by LottoStar will not be eligible for cancellation.
        7. Any malfunction voids bets and pays/winnings.
        8. Once a Player clicks “bet”, the bet price will be deducted directly from a Player’s Play Credits. In the event that a Player selects Auto Play, the bet price will be deducted as each bet is placed.
        9. To stop Auto Play, the stop button should be selected.
        10. LottoStar reserves the right to discontinue or to alter the Lotteries events in its sole discretion without providing reasons, regardless of whether advertising material continues to flight.
        11. Players acknowledge that they enter the Website and participate in the Lotteries at their own risk. The Lotteries are provided without any warranty whatsoever, whether express or implied. LottoStar shall not be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to the Lotteries. In the event of a malfunction, the Lotteries are void.
        12. The Player understands and acknowledges that if there is (or if the Player is later notified) that there is or has been a malfunction of the Lotteries, any stake made during such malfunction shall be deemed invalid and the result, null and void, regardless of whether Winnings have been paid out or the payout has been claimed. Winnings/payouts obtained by a Player in respect of malfunctioning Lotteries shall remain the property of LottoStar, inclusive of any subsequent lottery rounds bet on. Any stake from said winnings played in any subsequent Lotteries event round/s and the resulting shall also be deemed invalid and any winnings, null and void. LottoStar expressly reserves its right to claim any winnings from the Player in this respect directly.
        13. To the fullest extent permitted by law, LottoStar disclaims all liability for any cost, expense loss, damage, claim and/or liability to the Player or any third party, howsoever arising, in relation to the Website or its content, or the Player’s use of the Website or participation in the Lotteries event/s; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.
        14. Winnings from lotteries are strictly a once off cash payout only. The cash payout is not transferable and non-negotiable.
  8. ScratchCards

      1. General:
        1. All ScratchCard event transactions are displayed in the “My Account” section of the website.
        2. LottoStar reserves the right to discontinue or to alter the ScratchCard events in its sole discretion without providing reasons.
        3. The ScratchCard events are fixed odds betting events that result off of the outcome of a highly secure and independently certified Random Number Generator (“RNG”). Players agree that in the unlikely event of a discrepancy between the result that appears on their screen and result displayed on the game server, the result that appears on the game server will prevail. Players acknowledge and agree that LottoStar’s technical records will be the final authority in determining the circumstances of a Player’s participation in the relevant betting activity and the results of such participation.
        4. Only one payout may be won per ScratchCard event bet.
        5. All bets placed on the ScratchCard events are bet on a quick pick (QP) basis.
        6. All bets that have been validly placed and accepted by LottoStar will not be eligible for cancellation.
        7. The fixed-odds table available for each ScratchCard event must be consulted to determine a Player’s payout.
        8. In the event that a Player wins the maximum payout in accordance with any ScratchCard event and continues betting, which betting activity reduces the Player's Play Credit balance below any maximum payout of the ScrachCard event, LottoStar will only pay the remaining balance elected to be withdrawn in a cash amount. LottoStar will not be liable for any physical payouts where a Player has placed any bets subsequent to a win. LottoStar shall not be liable in any circumstance where the Player continues to bet. Any betting activity subsequent to any initial election made by a Player will be negated by such betting activity.
        9. All ScratchCard events not specifically mentioned below are cash values and are determined in accordance with the respective fixed-odds paytables available for each ScratchCard event.
        10. Sliding bet prices (may apply) and maximum payouts are applicable on each ScratchCard event.
        11. Once a Player clicks “bet”, the bet price will be deducted directly from a Player’s Play Credits. In the event that a Player selects Auto Play, the bet price will be deducted as each bet is placed.
        12. Any malfunction voids bets and pays/winnings.
        13. Players acknowledge that they enter the Website and participate in the ScratchCard events at their own risk. The ScratchCard events are provided without any warranty whatsoever, whether express or implied.
        14. LottoStar shall not be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to the ScratchCard events. In the event of a malfunction, the ScratchCard events are void.
        15. The Player understands and acknowledges that if there is (or if the Player is later notified) that there is or has been a malfunction of the ScratchCard events, any stake made during such malfunction shall be deemed invalid and the result, null and void, regardless of whether Winnings have been paid out or the payout has been claimed. Winnings/payouts obtained by a Player in respect of a malfunctioning ScratchCard event shall remain the property of LottoStar. Any stake from said winnings played in any subsequent ScratchCard event round/s and the resulting shall also be deemed invalid and any winnings, null and void. LottoStar expressly reserves its right to claim any winnings from the Player in this respect directly.
        16. To the fullest extent permitted by law, LottoStar disclaims all liability for any cost, expense loss, damage, claim and/or liability to the Player or any third party, howsoever arising, in relation to the Website or its content, or the Player’s use of the Website or participation in any ScratchCard event; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.
        17. The Player represents, warrants and expressly agrees that it shall indemnify and hold LottoStar and its licensees, successors, related entities, directors, officers, agents, members, third party contractors, employees and software providers (collectively, the “LottoStar Parties”) harmless from and against any and all direct, general loss or damage, liabilities, risk, losses, interest or penalties of whatsoever nature (whether direct, incidental, consequential, indirect or punitive damages) incurred or sustained by the Player by or in connection with accepting any payout in relation to a ScratchCard event.
        18. Any tier 1 – 3 winner, will be required to provide photographs and/or pose for photographs and videos and/or provide audio clips, which may be used in future marketing and public relations by LottoStar. Where necessary, LottoStar agrees to disguise a Player’s identity for purposes of its marketing and public relations, although a Player will still need to take part therein.
        19. Irrespective of any prize format, the Player will have to provide all valid documents as requested by LottoStar and as required by the Financial Intelligence Centre Act (FICA).
        20. LottoStar reserves the right to modify or discontinue the ScratchCard events in its sole discretion without prior notification or providing reasons, regardless of whether advertising material continues to flight.

        1. The top tier payout of R1.2 million is made up of a Toyota Hilux (the model of which will be at the Player’s discretion, subject to availability) and a cash value (if any).
        2. In the event that a Player wins the top tier payout, the Player can elect whether to accept any one of the below Payout Formats:
          1. a maximum payout of R1.2 million in cash; or
          2. a Toyota Hilux and the balance of the maximum payout in cash (if any);

        3. In the event that a Player elects to accept the Golf GTI, the following is applicable:

      5. Win Your Dream Home
        1. The top tier payout of R10 million is made up of a Home (the style of which will be at the Players discretion) and a cash value (if any).
        2. In the event that a player wins the top tier payout, the Player can select whether to accept any one of the below Payout Formats:
          1. a maximum payout of R10 million in cash; or
          2. a Home and the balance of the maximum payout in cash (if any).
        3. In the event that a Player selects to accept a Home the following is applicable:

        2. The maximum top tier payout (depending on the bet price) is a cash payout or an Aston Martin (“Vehicle”) as detailed above.
        3. In the event that a Player elects to accept the Vehicle, the following is applicable:

      Auto Play & Auto Cash-out

      a: Auto Play is activated from the “Auto” tab in the Bet Panel, by clicking the “Auto Bet” checkbox. After the auto-bet is activated, bets will be placed automatically, but for cash out, you must still make this determination by clicking the “cash-out” button in each round. If you want your bet to cash out automatically, then you can select the “auto cash-out” option.
      b: Auto cash-out is available from the “Auto” tab on the bet panel. After the auto cash-out is activated, your bet will be automatically cashed out, when/if the selected coefficient/multiplier is reached.

      Live Bets & Statistics

      a: The Live Bets panel is located on the left side of the game interface (or under Bet Panel on mobile). Here you can see the bets that you have placed in the current round.
      b: In the “My Bets” panel you can see all your bets and cash-out information.
      c: Game statistics are located in the “Top” panel. You can browse wins by amount or cash-out coefficient.

      In-game Chat

      a: The Chat Panel is located on the right side of the game interface (or after clicking the chat icon, on the top right corner of the mobile interface). The chat functionality can be used to communicate with other players. Information about big wins is also posted in the chat.

      Resulting

      a: A highly secure and independently certified Random Number Generator (“RNG”) determines the outcome of the Aviator event.

      Bet limits

      The bet limits are set as follows:

      a: Minimum bet amount = R1
      b: Maximum bet amount = R100 000
      c: Maximum win = R10 000 000.

      Your bet will automatically be cashed-out when your bet amount times the coefficient/multiplier equals to or exceeds the maximum win amount.

      Connection and Malfunction

      5. All bets that have been validly placed and accepted by LottoStar will not be eligible for cancellation.
      6. The minimum crash point of each crash game is 0.00x.
      7. Once a Player clicks “Bet”, and the multiplier begins calculating, the bet price will be deducted directly from a Player’s Play Credits.
      8. Players can activate and deactivate Auto Cashout and the multiplier by clicking the “ON/OFF” button.
      9. Any malfunction voids bets and pays/winnings.
      10. In the event of disconnection (i.e. internet connectivity disconnection or otherwise) and the crash point occurs, all bets are lost, and Players will not be refunded.

  15. Live Games - Evolution and Ezugi

      1. In addition to the standard LottoStar terms and conditions herein contained and the promotional terms and conditions available here, by placing a bet on any Live Game Players declare themselves to be acquainted with and agree to be bound by all Game Information “Game Info” under the Live Games and the Help tab of each respective game. In addition, a player may refer to the Evolution Services SA game rules here. For the avoidance of doubt, the Evolution Services SA game rules document is an all encompassing list and may include rules to games that are not available on LottoStar. In addition, the Evolution Services SA game rules are updated periodically so may not include games available on LottoStar. In this respect, Players declare themselves to be acquainted with and agree to be bound to all Game Information “Game Info” under the Live Games and the Help tab of each respective game and the rules contained therein shall prevail. LottoStar reserves the right in its sole discretion to determine what games are enabled and may add or remove games at its discretion.
      2. Bet limits may apply and it is the sole responsibility of the Player to adhere to same. Where bet limits are not adhered to by a player and exceeded, LottoStar shall have no responsibility to refund the Player in the event that the bet is accepted by LottoStar.
  16. Reel Rush, Reel Rush Privé and Slotteries

      1. General

        3. By placing a bet on the Reel Rush and Slotteries events, Players undertake and accept to comply with all of the Game Rules of each particular Reel Rush and Slotteries event.
        4. All bets that have been validly placed and accepted by LottoStar will not be eligible for cancellation.
        5. Any malfunction voids bets and pays/winnings.
        6. Once a Player clicks “bet”, the bet price will be deducted directly from a Player’s Play Credits. In the event that a Player selects Auto Play, the bet price will be deducted as each bet is placed.
        7. The optimal return to player of the Reel Rush and Slotteries events is 96% - 98%. The theoretical RTP is displayed under the “Help” section of each individual game.
        8. LottoStar reserves the right to discontinue or to alter the Reel Rush and Slotteries events at its sole discretion without providing any reasons and/or prior notification to the Player.
      2. 1x2 Gaming Network
        1. For purposes of these terms and conditions “1x2 Gaming Network” shall include the Iron Dog Studio and Prospect Gaming studio.
        2. The Information and How to Play tabs (hereinafter referred to as the “Game Rules”) available on each game should be consulted and understood before a Player engages with the 1x2 Gaming Network events. The Player undertakes and warrants that all of the Game Rules are understood and agreed to.

      6. The Reel Jackpot Race
        1. The Reel Jackpot Race rules, applicable games for participation and the minimum qualifying bet price can be found here.
        2. The Reel Jackpot Race is only available on selected Habanero games.
        3. The Reel Jackpot is not available on any of the Ruby Play, 1X2 Gaming Network or Red Rake events.
        4. By participating in the Reel Rush Jackpot Race, Players undertake and accept to comply with all of the Game Rules of each Reel Rush and Slotteries event and the How to Play section available in each participating Habanero event.
      7. Red rake Tournaments
        1. The Red Rake Tournament rules and Paytable can be found here. The top 500 ranked Players (i.e. the 500 players with the most amount of points at the end of the tournament) will win the monetary amount as indicated on the Paytable.
        2. All Red Rake games will be available for the tournament.
        3. The Red Rake Tournament is not available on Ruby, Habanero, Slotteries and 1x2 Gaming Network games.
        4. Payers will automatically participate if they are betting during the Tournament.
        5. By Participating in the Red Rake Tournament, players undertake and accept to comply with all the Game Rules of each Red Rake game and the How to Play section available in each participating Red Rake event.
  17. Banking

      1. Deposits:
        1. Players must register with LottoStar before making a deposit to their accounts.
        2. Deposits into the betting account may be made by debit/credit card, EFT, Direct Deposits, Capitec Pay@ Immediate App Transfer or any alternative method available from time to time on the deposits page. Payments must be from a debit/credit card or bank account in the name of the Player, however, all transactions are taken as having been authorised by the lawful cardholder. In the event that a Player makes a deposit using a bank account or debit/credit card not in their name, LottoStar reserves the right, but is not obligated to request all information it deems necessary in order to ascertain that the Player has the requisite authority to make deposits using such debit/credit card and/or bank account.
        3. For EFT deposits LottoStar will require either a bank generated proof of payment or email confirmation of your payment showing the account name and Player's name before we will process a deposit into a Player's account, unless this is automatically credited.
        4. For automatically credited deposits, players are to ensure that they use their current cell phone number that LottoStar has on record or their identity number. LottoStar shall not be held liable in the event that a payment cannot be traced due to an incorrect reference input by the Player. In the event that any amount is credited to another profile due to an incorrect reference input by a Player, LottoStar shall not be liable where such other Player has used the funds to place bets.
        5. The minimum deposit amount accepted by LottoStar (per deposit made) is R10.
        6. Money deposited into a LottoStar account is held by LottoStar on the client’s behalf until it is used to place a bet.
        7. Amount/s deposited into a Player's LottoStar account must be played through at least once before a withdrawal can be requested. In the event that an amount deposited is not played through at least once and a withdrawal is requested, LottoStar reserves the right to apply a fee, equal to the fee incurred by LottoStar for the processing of the deposit, to the deposited amount or any portion thereof that has not been played through before processing the withdrawal in question.
        8. All cancelled withdrawals are returned to the Player’s LottoStar account.
        9. LottoStar reserves the right to charge applicable processing/transaction fees, including but not limited to, any transaction or processing fees charged to LottoStar by third party merchants/processors.
        10. LottoStar reserves the right to charge a 5% (five percent) administration fee on amounts deposited by credit card.
        11. LottoStar reserves the right to charge any fees incurred where a Player has made a deposit and thereafter processes a withdrawal with no or a few betting transactions having been placed in comparison to the Players deposit amount/s. A Player's account may be suspended and any fees incurred by LottoStar for the deposit/s and withdrawal/s will be charged to the Player's account.
        12. Any bank charges or commission charge relating to the depositing of funds from a foreign bank account (Non South African account) irrespective of how these are charged, will be for the account of the Player/account holder. Where these are not assumed by the Player upfront on deposit and charged to LottoStar such bank charges or commission will be debited from the deposited amount and the balance will be credited to the Player account.
        13. No interest shall accrue on any amount held by LottoStar in a Player's betting account.
        14. LottoStar shall be entitled in its sole discretion, for any reason whatsoever, to define different minimum and maximum bet and/or deposit amounts for a particular Player.
        15. LottoStar is entitled to request proof that a Player has authority to use any payment method that is linked to their LottoStar Account.
        16. Any monies erroneously deposited into a Player’s account or LottoStar’s bank account will be reversed upon consideration of the circumstances surrounding the erroneous deposit. In terms of this, all bank charges or fees incurred to process the deposit and reversal will be borne by the Player or person who erroneously made the deposit. The erroneous deposit will only be reversed to the account from which it was received or to an account nominated by the erroneous depositor, provided it can be proved that the erroneous depositor owns the nominated account. LottoStar reserves the right to request any documentation it deems necessary in regards to the reversal of any erroneous deposit.
        17. LottoStar Voucher (including Discovery Bank), 1Voucher, Blu Voucher OTT Voucher, EasyLoad, Kazang and whatsoever vouchers LottoStar may add from time to time (“Voucher”):
          1. The full value of the Voucher must be played through entirely. Only once this has been met will LottoStar process a withdrawal of any winnings. Please note that no Voucher may be sold, exchanged or refunded for cash.
          2. It remains the sole responsibility of the Player to keep the redemption code safe. LottoStar will not be responsible for any lost, damaged or stolen redemption codes/Vouchers irrespective of whether the Voucher has been redeemed or not.
          3. Vouchers must be redeemed within 3 (three) years of purchase.
        18. Pay with Crypto
          1. Only the following Wallets are supported in connection with the Pay with Crypto depositing method:
            1. Luno; and
            2. VALR.
          2. Players understand that deposits made through Pay with Crypto are received by LottoStar as the Rand equivalent of the cryptocurrency and no cryptocurrency is received by LottoStar.
          3. The minimum deposit amount for Pay with Crypto is R100 per transaction. The maximum daily deposit and per transaction limit through Pay with Crypto is R40 000.
          4. The full value of the Pay with Crypto amount deposited must be played through entirely.
          5. No deposits may be made through Pay with Crypto until the Player account is fully FICA verified.
          6. It remains the sole responsibility of every person to keep their Crypto wallets and LottoStar betting accounts safe. LottoStar will not be responsible for any chargeback requests in respect to Pay with Crypto transactions whatsoever.
      2. Withdrawals:
        1. For EFT deposits LottoStar will require either a bank generated proof of payment or email confirmation of your payment showing the account name and Player's name before we will process a withdrawal.
        2. Withdrawals from a betting account will only be made to a bank account in the name of the Player.
        3. LottoStar will not be liable under any circumstances where any banking details have been manipulated and/or changed with or without the authorisation and/or involvement of the Player.
        4. LottoStar reserves the right to decline withdrawal requests where the Customer has requested payment to be made into a banking account in the name of any person other than that of the Player.
        5. LottoStar will only pay winnings out to South African bank accounts in South African Rands or any other recognised bank account, provided no jurisdictional restrictions apply.
        6. LottoStar relies solely on third party banking systems to effect withdrawals via EFT. Consequently, LottoStar accepts no liability should the service be made unavailable and/or for withdrawals being delayed for any reason whatsoever.
        7. If the Player places of a bet from a location falling outside of South Africa, such bet shall be subject to all appropriate exchange control regulations and the laws of the foreign jurisdiction from which such bet originates. It is and shall remain the sole responsibility of the Player to ensure full compliance with all regulations and laws in the jurisdiction from where they are placing a bet. LottoStar makes no warranties and shall not be liable, under any circumstances whatsoever, to the Player if it is not able to remit any monies held by it to any account in a foreign jurisdiction.
        8. Any bank charges or commission charge relating to the withdrawal of winnings to a foreign bank account (Non South African account), and irrespective of how these are charged, will be for the account of the Player/account holder. The bank charge will not be deducted from the winnings but the Player’s bank account will be debited with the bank charges in respect of the monies coming into his/her account. The commission charge will be deducted directly from the winnings a Player is withdrawing or directly debited from the Player's bank account.
        9. A minimum withdrawal value of R5000 applies to any withdrawals made to a foreign bank account.
        10. For withdrawals of R25 000 or more LottoStar may require the copies of Original FICA documents, which documents need to be certified as true in the event that they are requested. Notwithstanding this clause, LottoStar reserves the right to request a Players Original FICA documents at any time as per clause 3.6 of these terms and conditions.
        11. Payments will be processed on any weekday, excluding public holidays, subject to 24hrs notice to effect payment. LottoStar may withhold payment pending receipt in its bank account of all money paid to LottoStar by the Player.
        12. LottoStar only allows 1 (one) withdrawal to be processed at a time. Should a Player wish to amend the withdrawal amount and/or method of payment, they will be required to first cancel the initial withdrawal made before editing their withdrawal value and/or withdrawal method.
        13. LottoStar reserves the right to charge transaction fees, including but not limited to, an amount equal to any credit card transaction fees.
        14. The minimum Withdrawal amount via EFT is R100, R200 via ABSA CashSend, Nedbank Send-iMali and FNB eWallet and R500 via Instant Money from Standard Bank. ABSA CashSend, FNB eWallet, Nedbank Send-iMali and Instant Money from Standard Bank are subject to a maximum withdrawal amount of R25,000.00 in a 30 day period. The maximum daily Withdrawal limit through Instant Money from Standard Bank is R5,000.00 subject to the 30 day limit. The maximum daily Withdrawal limit through ABSA CashSend and FNB eWallet is R3,000.00 subject to the 30 day limit. The maximum daily Withdrawal limit through Nedbank Send-iMali is R4,000.00 subject to the 30 day limit.
        15. Nedbank Send-iMali reserves the right to reverse any unclaimed vouchers after 48 hours from the time the withdrawal was processed. The funds will be credited back to the LottoStar account within 24 hours of the reversal.
        16. LottoStar relies solely on the banking systems of Instant Money from Standard Bank, FNB eWallet, ABSA Cash Send and Nedbank Send-iMali to effect withdrawals into customer’s cell phone numbers. Consequently, LottoStar accepts no liability should the service be made unavailable and/or for withdrawals/SMS’s being delayed for any reason whatsoever.
        17. LottoStar will not be held liable in the circumstance where incorrect information is provided by a Player in respect to their bank account number and/or their cell phone number or any other relevant information.
        18. Money held in a LottoStar account may be refunded on request, subject to 24 hours’ notice to enable LottoStar to verify that all of the Terms and Conditions have been complied with.
        19. LottoStar reserves the right to withhold a withdrawal of monies where it is suspected that the account is not being used for a legitimate purpose, there are suspicious/irregular activities, including but not limited to money laundering and fraud. An inspection will begin on the account and all fees incurred in processing transactions will be charged to the Players account.
      3. Chargebacks:
        1. In the event that LottoStar incurs any chargebacks, payment reversals or any other charges in connection with a Player’s account, we reserve the right to recover such amounts directly from the Player.
        2. All Players warrant, represent, agree and undertake that no chargebacks, payment reversals or any other charges will be made in connection with a Player’s account without prior written approval from LottoStar. Should any chargeback, reversal or any other charge ensue, Players agree to indemnify and hold LottoStar harmless against any such amounts, costs, damages, claims or any other expense that may arise relating to chargebacks, reversals or other charges or in association with our efforts to recover such amounts from the Player.
      4. Credit Checks:
        1. LottoStar reserves the right, for legitimate purposes only in connection with a Player's LottoStar account, to run credit checks on all Players and cardholders with any third-party credit bureaus on any information provided by the Player on registration or otherwise.
  18. Dormant Accounts

      1. A dormant account means an account that has not been transacted on for a period of 180 days. An account is considered dormant if it has not had any activity i.e. if there has been no deposit, withdrawal or the placement of a bet for a period of 180 days. After 180 days, any funds in a dormant account will cease to be valid.
      2. Any monies in a deceased Player’s account will only be paid to the Estate bank account upon receipt of proof of same. LottoStar reserves the right to request any documentation it deems necessary pertaining to the Estate bank account and the Executor or Administrator of the Estate.
  19. Suspended, excluded or de-registered accounts

      1. In the event that an account is suspended for any reason whatsoever, including, but not limited to the instance where FICA documents are not presented in a timely manner upon request for same, any play credits, promotional credits, vouchers and winnings in that account will be forfeited.
      2. Any accounts that have been flagged for suspicious and/or fraudulent activities will be cancelled and any play credits, promotional credits, vouchers and winnings in that account will be forfeited.
  20. Security Policy

      1. LottoStar secures all Player information, both online and offline.
      2. All data is transmitted using SSL encryption.
      3. The Player is solely responsible for the safekeeping of their login, password, security details, account details and withdrawal banking PINS. The Player indemnifies LottoStar against any claims, losses or damages arising from unauthorized use of his or her account and/or where any information has been provided by the Player. Unauthorised transactions on a Player account will not be cancelled by LottoStar.
      4. LottoStar assumes no responsibility for accounts created using stolen or compromised personal information, including those resulting from identity theft. LottoStar shall not be liable for any losses, damages, or unauthorised activity arising from such incidents.
      5. LottoStar understands the importance of information security and the techniques needed to secure information. We host all personal information received from our Players in an encrypted and password-protected cloud storage facility, which resides behind active state-of-the-art firewall software. LottoStar takes steps to ensure that subsidiaries, agents, affiliates and suppliers also employ adequate levels of information security.
  21. Player Data Privacy Notice - Consent and Acknowledgement

      1. I hereby expressly make the following acknowledgements either in respect of LottoStar’s processing of my Personal Information and/or Special Personal Information (collectively referred to as “Personal Information”), as defined in the Protection of Personal Information Act, 4 of 2013 (POPIA):
      2. That I have read and understood the provisions of LottoStar’s Privacy Notice which is available here, thereby fully appreciating the manner in which LottoStar may process my Personal Information and for which purpose(s) LottoStar may process such Personal Information.
      3. That by engaging with LottoStar through any physical and/or electronic means, and specifically in my LottoStar dealing, LottoStar will in effect be processing the Personal Information provided by me from time to time.
      4. That LottoStar may from time to time, depending on the circumstances, collect my Personal Information from another source other than myself.
      5. That I fully appreciate that LottoStar places a high premium on my privacy.
      6. That I have read and understood the undertakings made by LottoStar in its Privacy Notice to which this consent form relates, to the effect that it will ensure that any and all of my Personal Information shall be processed with a reasonable standard of care as may be expected from LottoStar.
      7. That I fully appreciate that LottoStar will only process my Personal Information in a manner consistent with the provisions of its Privacy Notice to which this consent relates, as well as for the purpose(s) set forth therein.
      8. That, in accordance with the provisions of Section 18 of POPIA, I have been provided with adequate notification of the processing of my Personal Information by LottoStar, the scope and purpose(s) for such processing, as well as my rights to object to such processing should I elect to do so.
      9. That I acknowledge that the processing of my Personal Information is a mandatory requirement for LottoStar to be in a position to render services to me.
      10. In light of the above acknowledgements, and in as far as it is in fact required in terms of the provisions of Section 11 of POPIA, I hereby provide my specific and informed consent to LottoStar for the processing of my Personal Information, for any purpose(s) legitimately connected or related to LottoStar business operations, which purpose(s) have been set out in LottoStar’s Privacy Notice to which this consent form relates.
  22. Delivery Policy

      1. A confirmation message will be displayed on the website and a bet slip will be generated when a bet has been placed successfully. Bets are deemed to have been accepted as soon as they have been registered on our system and a transaction has been processed against the Player’s betting account and a bet slip has generated, regardless of whether or not the confirmation message is received by the Player.
      2. All bets accepted after the official start of an event will be void, unless the event is specifically labelled as being available for betting in running.
      3. The Player is solely responsible for ensuring that bets are placed accurately. Bets cannot be cancelled by the Player once accepted by LottoStar.
  23. Intellectual Property

      1. The Player or any other party shall have no right to copy, in whole or in part, the LottoStar Product, software and website and shall not modify, adapt, translate, reverse engineer, decompile, disassemble, re-distribute, re-sell or create derivative works based on the LottoStar Product.
      2. Nothing in this agreement will function to transfer either party's Intellectual Property rights to the other party.
      3. LottoStar will retain all interest in and to the betting service, including all documentation, modifications, improvements, upgrades, derivative words, and all other Intellectual Property rights in connection with the betting service, including LottoStar's name, logos. and trademarks reproduced through the betting service.
      4. Player relinquishes his/her rights, title, and interest, in total, including all intellectual property rights, in and to (a) the Player’s content; and (b) all data and reports provided to the Player by LottoStar prepared based on analysis of the Player’s content, subject to LottoStar’s underlying rights in the betting service.
  24. Dispute Resolution

      1. Any dispute that a Player may have with LottoStar must follow the following process: a brief summary of the dispute together with the contact details of the Player must be sent to legal@lottostar.co.za, LottoStar will thereafter consider the dispute and respond within 5 business days, unless a longer period is required by LottoStar and communicated to the Player.
      2. If LottoStar and the Player are unable to resolve the dispute to the satisfaction of both parties within the stipulated timeframe required by LottoStar, LottoStar will inform the Player that the dispute should be referred to the Regulator for resolution.
      3. In certain circumstances, LottoStar will refer the dispute to the Regulator for independent evaluation thereof.
      4. The Player is not precluded from lodging a complaint directly with the Regulator.
      5. The Regulator shall conduct whatever investigation it deems necessary to resolve the dispute and shall serve a written notice on LottoStar and the Player, informing them of the Regulator’s determination and/or resolution.
      6. The determination and/or resolution of the Board shall become effective on the date when the parties receive a written notice of the determination and/or resolution. The determination and/or resolution shall be considered final and binding on the parties, save that, should either party not be satisfied with the outcome of the Regulator then, and in that case only, will the parties be permitted to approach a court of law with competent jurisdiction to determine the matter.
  25. Exclusion

      1. LottoStar takes responsible gambling/betting extremely seriously. Players are advised to bet responsibly, and it is the sole obligation of the Player to do so. LottoStar will not be held liable or responsible in circumstances where Players do not bet sensibly.
      2. Players are able to exclude themselves:
        1. By contacting our call centre via any of the contact methods available on our contact us page and advising them that you would like to self-exclude.
        2. By completing the self-exclusion form available here and submitting the fully completed form to our call centre.
      3. Players are entitled to set their own exclusion period in ordinary requests and circumstances of exclusion and as such Players are expected to abide by the set time periods and terms of the exclusion.
      4. Players who express to have a gambling/betting problem and who request to be excluded will be asked to complete the self-exclusion form which will ban them from betting/gambling activities for at least six months. Where a self-exclusion form is completed, LottoStar reserves the right to make this available to the Mpumalanga Economic Regulator and any other regulatory bodies that supervise responsible gambling/betting. LottoStar will not under any circumstance re-activate a Player account within a six-month period from the date that the self-exclusion form has been submitted. Whilst it is clear that LottoStar will take reasonable efforts to give effect to a Player's request for exclusion, it is the responsibility of Players to ensure that they refrain from participating in betting during the period of exclusion.
      5. LottoStar reserves the right to permanently close a Player account in circumstances where it deems a Player may have a gambling/betting problem.
      6. LottoStar shall not be responsible for any loss of a self-excluded player who creates a betting account under a different name and/or under false pretences places bets before LottoStar becomes aware of the self-exclusion application.
      7. The responsibility to bet responsibly rests solely on Players.
      8. In the event that a Player believes that they have a gambling/betting problem they are advised to contact the National responsible Gambling Programme on 0800 006 008 for further assistance.
      9. Should it become known to LottoStar that a Player has excluded themselves with any other operator and/or betting or gambling regulator, LottoStar reserves the right to deactivate such Player accounts.
      10. Self-exclusion/restraint is a Player’s sole responsibility.
      11. LottoStar will not be held accountable in circumstances where the Player fails to exercise restraint, irrespective of whether there has been negligence on the part of LottoStar.
      12. LottoStar shall not be liable for any loss of a Player who fails to bet responsibly and/or exercise self-restraint.
  26. Wagering

      1. A Player’s total account balance consists of a Play Credit Account and a Bonus Credit Account. Withdrawals cannot be made from the Bonus Account, but the Bonus Credit Account can be used to place wagers. You will be unable to withdraw any amount from your account until you have met the wagering requirements (if any).
  27. Winnings

      1. All Player’s winnings will automatically be converted and credited to a Player’s play credits. All winnings must be withdrawn/bet within ninety (90) days of allocation thereof, failing which they will be forfeited.
      2. LottoStar will pay all lawful winnings out within 30 days from the date that the winnings are actually won.
      3. All Player's winnings, irrespective of the amount, can be advertised by LottoStar and can be used in any of LottoStar's marketing campaigns. In terms of this, Players will be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by LottoStar. Where necessary/specifically requested, LottoStar agrees to disguise a Player’s identity for purposes of its marketing and public relations, although a Player will still need to take part therein. Players agree that LottoStar may publish/advertise (across any medium) a Player's initials with such Player's corresponding winning amount without requiring permission from any Player to do so. The use/publication of a Player's initials only will be deemed adequate to disguise any Player's identity.
      4. Winnings shall only be paid to the lawful winner. No winnings shall be payable to any third person. Winnings are not transferrable. Winnings will only be paid in the event that a Player is fully verified and has provided all FICA documentation required.
  28. The Star Foundation - Donations

      1. LottoStar’s The Star Foundation (“TSF”) www.thestarfoundation.co.za is a non-profit company (NPC) with registration number: 2017/527992/08 and a registered Public Benefit Organisation (“PBO”) with exemption reference number: 930074326 that supports and gives back to communities across the Country.
      2. Players can donate their Play Credits to causes from time to time managed by TSF. Once a Player has successfully donated their Play Credits, no refunds, reversals or the like may be processed irrespective of the circumstances.
      3. Players can donate their Play Credits in predetermined values or enter their own amount that they wish to donate.
      4. Section 18A (i.e. tax deduction) certificates will be issued to Players for all donations made and will be sent by the end of February annually by TSF. Players’ consent to their Personal Information being shared with TSF for purposes of issuing this section 18A certificate.
      5. LottoStar and TSF shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with LottoStar's website or in respect to any donation made by a Player to any cause managed by TSF.
      6. LottoStar reserves the right to deactivate any Player account that appears to and/or is making donations for any illegitimate or illegal reasons.
      7. While every effort will be taken to screen all causes in respect to individuals and other NPOs/NGOs/PBOs, TSF and LottoStar ultimately cannot warrant that Player donations will be used for any particular purpose and shall not be responsible for any dissatisfaction that Players may have regarding the recipient use of any donation Players have made through the website or for any misuse or non-use of such donations by the recipient.
      8. In certain circumstances and/or for certain causes, LottoStar will match donated amounts by Players.

The Player warrants that they have read, understood, accepted and will comply with all of LottoStar's General and Promotional Terms and Conditions and Privacy Notice.
